1 Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Templateshut ("we", "us", "our"), operating at https://templateshut.com.

By accessing the Service, creating an account, or clicking any confirmation button, you confirm that:

• You are at least 18 years of age or the legal age of majority in your jurisdiction.
• You have the legal capacity to enter into a binding agreement.
• You have read, understood, and agree to these Terms and our Privacy Policy.

If you are using the Service on behalf of an organisation, you represent that you have authority to bind that entity to these Terms.

2 Description of Service

Templateshut is an AI-powered website generation platform that allows users to create complete HTML websites by providing text-based prompts. Output is generated using Claude (by Anthropic, Inc.) and delivered as downloadable HTML code.

The Service includes:

• Access to the AI website generation tool via a web browser.
• Cloud storage of your generation history for the duration of your account.
• Subscription-based monthly generation quotas as described in your selected plan.
• Account management, billing, and support features.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. Active paid subscribers will receive a pro-rated refund in the event of a full service discontinuation.

3 Account Registration

To access most features, you must create an account. You agree to:

• Provide accurate, complete, and current registration information.
• Keep your account information up to date at all times.
• Maintain the confidentiality of your password and not share your credentials with any third party.
• Be solely responsible for all activity that occurs under your account.
• Notify us immediately at [email protected] if you suspect any unauthorised access to your account.

You may not create more than one free account. Creating multiple accounts to circumvent usage limits violates these Terms and may result in immediate termination of all associated accounts without refund.

4 Subscription Plans & Billing

4.1 Available Plans

• Free Plan: 3 website generations per month — no payment required.
• Pro Plan: 50 generations per month — ₹999 INR per month.
• Enterprise Plan: Unlimited generations — ₹5,999 INR per month.

Current prices and features are always displayed on our Pricing page. We reserve the right to change pricing with at least 30 days' prior written notice to active subscribers.

4.2 Billing Cycle

Paid subscriptions are billed on a monthly recurring basis from the date of your initial subscription. Billing is automatic unless you cancel before the renewal date.

4.3 Payment Processing

All payments are processed securely by Razorpay By subscribing, you authorise us to charge your chosen payment method monthly. You are responsible for keeping your payment information current. Failed payments may result in temporary suspension of your account access.

4.4 Usage Limits & Resets

Generation quotas reset monthly on your billing anniversary date. Unused generations do not carry over to the next billing period. Exceeding your plan's limit will block further generation until the next reset date or until you upgrade your plan.

4.5 Taxes

Prices are quoted in INR and are exclusive of applicable taxes, including Goods and Services Tax (GST) in India. Any applicable taxes will be added to your invoice as required by law.

5 Refund & Cancellation Policy

5.1 How to Cancel

You may cancel your subscription at any time via your Billing page or by emailing [email protected]. Upon cancellation:

• Your subscription remains fully active until the end of the current billing period.
• You will not be charged for any subsequent billing period.
• Your account automatically reverts to the Free plan at the end of the active period.
• Your generation history and account data are retained unless you separately request account deletion.

5.2 Eligible Refunds

We offer refunds in the following circumstances:

• 7-Day Money-Back Guarantee (New Subscribers Only): If you are subscribing to a paid plan for the first time and are not satisfied with the Service for any reason, you may request a full refund within 7 calendar days of your initial subscription date. This guarantee applies once per customer per plan tier and does not apply to renewals, subsequent subscription periods, or plan upgrades.
• Extended Service Downtime: If the core AI generation feature is unavailable due to a fault on our side for more than 24 continuous hours in any billing period, you may request a pro-rated credit for that period upon providing evidence of the reported issue.
• Duplicate or Erroneous Charges: If you have been charged in error or billed more than once for the same period, we will investigate promptly and issue a full refund for the incorrect charge within 5 business days of confirmation.
• Service Discontinuation: If Templateshut permanently discontinues the Service, all active paid subscribers will receive a pro-rated refund for the unused portion of their current billing period.

5.3 Non-Refundable Circumstances

Refunds will not be granted in the following situations:

• More than 7 calendar days have elapsed since the initial subscription date (for money-back guarantee requests).
• You have consumed more than 50% of your monthly generation quota in the billing period in question.
• Your account was suspended or terminated due to a violation of these Terms, including misuse or breach of the Acceptable Use Policy.
• Dissatisfaction with the aesthetic quality or style of AI-generated output, as generation results are inherently variable and depend on the quality and specificity of the prompts provided.
• Partial months resulting from a plan downgrade or cancellation that you initiated voluntarily.
• Renewal periods — only the initial 7-day window applies to the money-back guarantee.

5.4 How to Request a Refund

To request a refund, send an email to [email protected] with the subject line "Refund Request — [Your Registered Email]". Please include your registered email address, your subscription start date, and the reason for your request. We will acknowledge your request within 2 business days and provide a final decision within 5 business days. Approved refunds will be credited back to your original payment method within 5–10 business days, subject to your bank or card issuer's processing timeline.

6 Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use Templateshut to:

• Generate websites promoting or facilitating illegal activity, violence, hate speech, or discrimination based on race, religion, gender, caste, sexual orientation, disability, or nationality.
• Create phishing websites, scam pages, malware-distributing sites, or any content intended to deceive or defraud others.
• Generate content that infringes any third party's intellectual property, privacy, or other legal rights.
• Attempt to reverse-engineer, extract, or circumvent our underlying AI prompts, API credentials, or proprietary source code.
• Use automated scripts, bots, crawlers, or other tools to access or abuse the Service beyond normal user behaviour.
• Create multiple free accounts to circumvent generation limits.
• Resell, sublicense, or grant access to the Service to third parties without our prior written consent.
• Upload or transmit viruses, malware, ransomware, or any other malicious code.
• Interfere with, disrupt, or attempt to gain unauthorised access to our servers, networks, or infrastructure.

Violation of this policy may result in immediate account suspension or termination without notice or refund.

7 Intellectual Property

All rights, title, and interest in and to the Service — including its design, logo, user interface, software, documentation, and trademarks — are and remain the exclusive property of Templateshut and its licensors.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for its intended purpose in accordance with these Terms. This licence does not permit you to copy, modify, distribute, or create derivative works from any part of the Service, or to use Templateshut's name, logo, or trademarks without prior written consent.

8 Generated Content & Ownership

The HTML output generated through the Service in response to your prompts is provided for your use. Subject to your compliance with these Terms:

• You own the generated output and may use it for any lawful personal or commercial purpose.
• No attribution to Templateshut is required in your generated websites.
• You are solely responsible for reviewing generated content before use and for ensuring it does not infringe any third-party rights.

We do not claim ownership over your generated output but retain the right to use aggregated, anonymised generation data to improve the Service. We grant no rights in the underlying Claude AI models, which are owned by Anthropic, Inc.

We make no warranty that generated content is original, non-infringing, or fit for any particular purpose. AI-generated code should always be reviewed by a qualified developer before deployment in any production environment.

9 Third-Party Services

The Service integrates with Razorpay (payments), Anthropic (AI generation), and Google/GitHub (authentication). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party service.

The quality of AI-generated output depends on Anthropic's Claude model and its capabilities at the time of generation. We cannot guarantee that every generation will meet your specific requirements in every instance.

10 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TEMPLATESHUT DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT AI-GENERATED OUTPUT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PURPOSE.

11 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TEMPLATESHUT AND ITS DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNTS PAID BY YOU TO TEMPLATESHUT IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) INR $50.

12 Indemnification

You agree to indemnify, defend, and hold harmless Templateshut and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: your use of the Service in violation of these Terms; any content you generate, submit, or distribute through the Service; your violation of any third party's intellectual property, privacy, or other rights; or your violation of any applicable law or regulation.

13 Termination

By You: You may close your account at any time by contacting [email protected]. Any active subscription will be cancelled at the end of the current billing period. No refund is issued for the remaining period unless you are eligible under Section 5.

By Us: We reserve the right to suspend or permanently terminate your account immediately and without notice if you breach any provision of these Terms, engage in fraudulent or abusive activity, or if payment repeatedly fails and is not resolved within 7 days of written notice from us.

Effect of Termination: Upon termination, your right to access and use the Service ceases immediately. Sections 7, 10, 11, 12, and 15 of these Terms survive termination and remain in full force.

14 Changes to Terms

We may update these Terms at any time. For material changes, we will: update the "Last updated" date above; notify registered users by email at least 14 days before the changes take effect; and display a prominent notice on the Service. Continued use of the Service after the effective date constitutes your acceptance of the revised Terms. If you disagree with any change, you must stop using the Service before the effective date.

15 Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Informal Resolution: Before initiating any formal legal proceedings, you agree to first contact us at [email protected] and attempt to resolve the dispute informally. We will make reasonable efforts to reach a resolution within 30 days.

Arbitration: If informal resolution fails, any dispute, controversy, or claim arising out of or in connection with these Terms or the Service shall be finally resolved by binding arbitration conducted in accordance with the Arbitration and Conciliation Act, 1996 of India. The arbitration shall be conducted in the English language, and the seat of arbitration shall be Thiruvananthapuram, Kerala, India.

Courts for Interim Relief: Notwithstanding the above, either party may seek interim or injunctive relief before the courts of Thiruvananthapuram, Kerala, India, which shall have exclusive jurisdiction for such matters.

Class Action Waiver: All disputes shall be resolved on an individual basis. You waive any right to bring or participate in any class action, collective, or representative proceeding against Templateshut.
